Law of Obligations Act was taken as the base of the regulation.
The lease contract allows the person the tenant to possess and use the property belonging to the other person lessor. The tenant has to pay for that a reward a payment for the possession and use of property. In the hereby work the definition of the lease contract, its types, terms of conclusion, subjects and the aim of the contract as well as the most important terms and conditions, the form of the contract established by Law, execution and operation of the contract, including the rights and duties of parties, the peculiarities of execution of the most important terms and conditions, essential violations have been studied.
While examining the provisions of Law of Obligations Act concerning the lease agreement, the author compared them with the provisions of the Civil Code of Russian Federation and with the provisions of operating Law in Estonia, that regulates legal relations of the same content.
As a result the author came to the conclusion that Law of Obligations Act regulates this type of contracts most fully.
